NEWS

24/06/22 : We are pleased to announce that we have received authorisation to accept instructions directly from individual corporate entities and members of the public, on insurance policy wordings, insurance coverage and claims disputes, without need for intercession of a solicitor. This will be an advisory service only.

This follows considerable demand for our services from cash-strapped companies during the period of the pandemic, which resulted in us providing free advice, as a “friend” (the only way in which our legal expertise could properly be applied), in order to help point them in the correct direction in their dealings with insurers.

In order to avoid potential pitfalls, of which there are many, we intend initially to accept instructions only from corporate entities, on the basis that they are more likely to be legally sophisticated, making it less likely that we and/or the client will suffer any such fall.

We will not be seeking authorisation to conduct litigation, as we think it best that we confine our additional function to that of providing legal advice directly to clients at the stage when it is most needed, over 95% of cases settling prior to litigation.

If you have any queries or enquiries, please feel free to call my clerk, Elton Maryon, on 020 3056 8883 or 07802 462 966, or me directly on 020 3056 8878 or 0770 490 3378, or email us at eltonmaryon@maryonwynter.co.uk or colinwynterkc@maryonwynter.co.uk.

CASE NEWS

Parshall v Society of Lloyd’s [2020]; Comm Ct – settlement of £5.8m claim brought by Lloyd’s Name against The Society of Lloyd’s, for breach of contract, and requiring penetration of Lloyd’s immunity from suit (Lloyd’s Act 1982). Amongst the matters in issue was the applicability of the proviso to the immunity, whereby the immunity would be lost where it could be established that Lloyd’s had acted in “bad faith”. Settlement means that the question of when and in which circumstances the immunity can be penetrated must await another case, on another day.
